Linda Bendali:“The more we exercise the right of access to our personal data, the easier it will be to exercise it”
Member of Elise Lucet's team for the famous France 2 programme “Cash investigation”, Linda Bendali created a stir in France and beyond with her investigation entitled “Our personal data is worth gold!”. For this report, the journalist approached the founder of HestiaLabs to ask 40 companies for the data they had on her. One month after the first broadcast (20 May 2021), she looks back on the shockwaves caused by her work and invites everyone to continue it by asking, as she did, for access to their data.

Your investigation caused a huge stir on social networks. But beyond these reactions, has it had any concrete impact on the digital malpractices that you expose?
Yes, in the first week after the publication, the company ColdCRM closed and the MyGrossesse application was deactivated. The CNIL issued a press release announcing an investigation into the company Iqvia, which stores and processes health data of pharmacy customers in France. The same CNIL received a warning from a group of associations and trade unions concerning the authorisation it had given to Iqvia to enter a partnership with pharmacies for the exploitation of this health data. The concrete impacts are therefore significant.
How did HestiaLabs' founder help you carry out this survey?
Paul-Olivier helped me to understand how to write an access request and the mandatory steps for these SARs (Editor's Note: Subject Access Requests) to succeed. I used some of the templates he put online. I contacted him in October 2019 and sent 40 of them between November and December of the same year. It's a huge job, finding the name of the DPO (ndlr: Data Protection Officer) for each company, the address where to send it... It doesn't show when you watch the report, but it represents the major part of the time I spent working on this investigation.
You also came all the way to Lausanne to attend a “participatory experiment” during which some fifty readers of Le Temps were invited to collect their personal data from Facebook, their telephone operator or their health insurance. What did you learn from this?
After tearing my hair out to get my data, I wanted to see how people would react to this approach. Le Temps' initiative is great for two reasons: the newspaper made noise about a little-known right, and it pushed people to exercise that right. The more you exercise a right, the easier it is to exercise it. It is therefore very important that there are more initiatives of this kind in the future, and that there is more support for dealing with the complexity of access requests.

When Cash Investigation does this, there are over 100,000 reactions on social networks and investigations are immediately launched. But you know as well as I do that if a “normal” citizen does it, nothing will happen, right? It's a bit discouraging...
I am an average citizen. As we say in the report, I made 40 requests for access, and I only received one response within the time limit set by the GDPR law, which is one month. After four months, I had only received 13. We need to talk about this problem to get things moving. That is the role of the media. A film like the one I made, other investigations on this subject, the increasing number of scandals about data leaks... all of this ends up forcing companies to put the right processes in place. In your report, Élise Lucet questioned the French Secretary of State for the Digital Economy, Cédric O, about the few answers you received. He regretted it. But how can you be sure that this regret will be followed up?
That is the CNIL job. But citizens also have a role to play. The report had the merit of bringing these malfunctions to light. Now it is up to everyone to take the subject in hand, helped by organisations like yours. We, the media, will be there to highlight your initiatives. I hope that you and other associations or collectives will strike while the iron is hot. We must multiply the requests for access. And report to the supervisory authorities if these SARs remain unanswered.
